Terms of use and disclaimer
No sharing of login details beyond your charity
The user guarantees that the login details will not be shared beyond the personnel of the charity. [That means, for example: if you share it with someone and they share it with someone outside the charity – you are still liable.] By “charity”, this means the legal entity you are employed by, or the principal charity you volunteer for. [So, if you work for a network or federation of member charities, you cannot share it with your members.]
This is educational, not advice
This website is composed of ideas to help educate you. For example: points on this site may not apply to your circumstances, or if they do, may not apply in the most obvious way.
No guarantee as to accuracy
(Whilst the lead author has attempted to ensure the accuracy of the site) no guarantee as to accuracy is given. We also do not guarantee the accuracy of any courses, books, web content, or other materials or authorities linked to or referenced in this site. The site spans a huge range of material and the lead author makes no claims at all to fully understand or be expert in any of it. The site is designed for experienced professionals who are capable of forming their own independent opinions, to challenge them and make them think.
What can or can’t you do with the content of this site?
You are not allowed to reproduce more than a webpage of this site or any of the videos or interviews, etc behind the paywall. The ideas are not copyright Jonathan Ashton, but all the text and other media on the site are. The only commercial purpose for which you can use the text, videos, interviews, etc of this site is for the grants fundraising of your organisation.
On the other hand, the materials that are not behind the paywall are free for any use you choose, as long as they do not demean the authors of the site or the site itself.
You can only share materials downloaded from the site if you retain the Good Grant Fundraising logo and attribute the materials to the Good Grant Fundraising website.
What is incorporated into the terms of use
Privacy policy for the site and the disclaimer are incorporated into the terms of use. By agreeing to the terms of use, you are agreeing to these, too.
Right to change the terms of the terms of use
The author of the site reserves the right to vary the terms of use.
Right to take down the website
The lead author of the site, Jonathan Ashton, is entitled to take down the site and to delegate this authority if necessary. He is entitled to take down the site for a 24 hour period and between the hours of 1am and 7am UK time where this is required for maintenance. If it becomes necessary to take the site down entirely, this he is permitted to do so and in return must refund a proportion of the subscription fee equivalent to the unused proportion of the paid subscription. [So for example, if six months of a 12 month subscription remain, 50% of the subscription is to be refunded.]
You can only use the website lawfully
You cannot use this site for illegal purposes or in order to commit torts. [Torts are kind of the civil law equivalent of crimes.]
We can contact you back
If you contact us, we reserve the legal right to contact you back, subject to the terms of the privacy policy.
We have the right to use the information you give us
We retain the right to use the information you give us for the purposes of the Good Grant Fundraising website, subject to the terms of the privacy policy. That includes using for publicity the comments/testimonials that you leave.
No warranties and limited liability
No warranties are offered by the site. That includes that there is no guarantee related to the content of guests on the website (e.g., guest articles, people interviewed or featured on panels). The user accepts that any liability resulting from torts/breaches of contract related to this site is limited to the cost of a year’s licence to the site for a normal subscriber. [This is not intended as a serious commercial endeavour. A side project that might not pay for itself and very likely will make a lot less money that the lead author could make if he spent the same amount of time consulting, it is intended as a fairly altruistic effort to challenge people to find good practice. The user participates on that basis, alone.]
Partial money back guarantee
After the expiry of three months from the start of the subscription, if the user has not changed their trust fundraising in three ways, they are entitled to terminate their subscription and reclaim 50% of the subscription paid for most recently [50% goes towards the site and you are welcome to reclaim that. The 50% which has gone into a charitable trust, and may have been given away, you are not entitled to reclaim.] In thevent that the subscription was provided as an extra for a more expensive premium service, the amount that can be reclaimed is 50% of a standard rate annual subscription.
Dispute resolution
Any dispute should be settled by arbitration if possible. If not, it will be settled under English law.
